Terms of Service

These terms govern your use of the products and services operated by Foundly Labs Pty Ltd, an Australian company trading as Mythryl Studio ("Mythryl"), of Brisbane, Queensland.

In these terms, "the Services" means the website at mythryl.com, the Mythryl Online account service, the games published by Mythryl including Vestalborne, any pre-release build of those games, and the Mythryl mailing list.

By using the Services you accept these terms and the Privacy Policy, which forms part of them. If you do not accept them, do not use the Services.

Mythryl may amend these terms. The date above records the current version. Where an amendment materially reduces your rights, Mythryl will publish notice on the site and notify account holders by email at least 14 days before it takes effect.

Eligibility

You must be at least 13 years of age to hold an account, or at least 16 in the European Economic Area, the United Kingdom, and any other jurisdiction that sets a higher age for consent to online services. If you are under 18, a parent or guardian must accept these terms on your behalf.

Accounts

  1. A person may hold one Mythryl Online account. Authentication is by linked platform account (Steam, Discord, Google, Apple, GitHub or X), by passkey, or by single-use link sent to an email address. Mythryl does not issue or store passwords.
  2. You are responsible for all activity conducted through your account. You must keep your linked platform accounts and passkeys secure, and notify Mythryl at hello@mythryl.com if you believe another person has obtained access.
  3. Linking an additional platform account is permanent. Mythryl will not link accounts without your confirmation.
  4. Accounts are personal. You must not share, sell, rent, transfer or trade an account.
  5. Display names and avatars are supplied by the platform used to sign in. Mythryl may reset a display name that is offensive, that impersonates another person, or that is used to circumvent enforcement action.
  6. You may close your account at any time by contacting Mythryl. Mythryl may close an account that has been inactive for three years, after giving prior notice to a contactable address.
  7. Single-player, local network and dedicated-server play do not require an account. Unavailability, discontinuation or closure of the account service does not affect your ability to play a game you have acquired.

Purchases and refunds

  1. Mythryl does not sell directly and does not process payments. Games are sold by third-party storefronts, including Steam, the Epic Games Store, itch.io and console stores, under the terms of those storefronts.
  2. The storefront is the seller. Payment, taxation and refunds are administered by the storefront under its own refund policy. Mythryl cannot refund a transaction it did not receive, but will assist you in directing a request to the correct party.
  3. Mythryl does not receive or store payment card or bank details.
  4. Demonstration and playtest builds are supplied at no charge and may be modified or withdrawn at any time.
  5. Nothing in these terms excludes, restricts or modifies a right or remedy conferred by the Australian Consumer Law, or by the consumer law of your own jurisdiction where that law does not permit exclusion.

Licence

Games are licensed, not sold. Subject to these terms, Mythryl grants you a personal, non-exclusive, non-transferable and revocable licence to install and play its games on devices you own or control, for as long as your entitlement remains valid.

You may:

  1. play single-player, over a local network, and on servers operated by you or by other players;
  2. record, broadcast and publish footage of the games, including footage from which you derive revenue;
  3. create modifications, subject to the User content section below;
  4. retain a backup copy where applicable law permits.

You must not:

  1. reproduce, distribute, sell, rent, lease or sublicense a game;
  2. circumvent or interfere with a security, entitlement or licence verification measure;
  3. reverse engineer, decompile or disassemble a game, except to the extent applicable law permits notwithstanding this restriction;
  4. remove or obscure a proprietary notice;
  5. incorporate Mythryl code, artwork, audio or text into another product, or use it as training data for a machine learning model, without prior written permission;
  6. charge for access to a server, or sell in-game advantage on a server, without prior written permission. Voluntary contributions toward hosting costs are permitted;
  7. use cheats, automation, memory editors or modified clients that affect other players.

Pre-release builds

Alpha, beta, demonstration and playtest builds are incomplete. They may contain defects and may result in loss of progress. Worlds, characters and progress may be reset at any time, including on release, without notice or compensation. Features present in a pre-release build may be altered or removed, and their removal does not constitute a breach of these terms. A build supplied in confidence must not be disclosed. Mythryl may end a playtest and revoke access at any time.

Multiplayer and player-operated servers

  1. Servers are generally operated by players rather than by Mythryl. The operator of a server determines its rules, receives the IP address of each connected player, and is responsible for its operation.
  2. Mythryl does not operate, monitor or moderate player-operated servers and accepts no responsibility for them.
  3. If you operate a server you are responsible for its conduct, for any personal information you collect from its players, and for compliance with the law of your jurisdiction. You must not represent a server as official or as endorsed by Mythryl.
  4. In-session chat is relayed by the server host. Mythryl does not receive or retain it.

Acceptable use

This section applies to the account service, any service operated by Mythryl, the Mythryl Discord server, and correspondence with Mythryl.

You must not:

  1. harass, threaten or abuse any person, or publish content that vilifies a person or group;
  2. publish unlawful content, or the private information of another person;
  3. impersonate Mythryl, its personnel, or any other person;
  4. transmit unsolicited advertising, chain messages or fraudulent communications;
  5. cheat, exploit defects, or deliberately disrupt the play of others;
  6. attack the infrastructure of Mythryl or of any player, including by denial of service;
  7. distribute malicious software, or a modified client that causes harm to other players;
  8. register an account in order to circumvent a suspension;
  9. access the Services by automated means beyond a published interface, or at a rate that degrades them.

Security vulnerabilities should be reported to hello@mythryl.com and should not be disclosed publicly until Mythryl has had a reasonable opportunity to remedy them.

User content and modifications

  1. You retain ownership of content you create, including modifications, worlds, screenshots and recordings.
  2. For content submitted to a service operated by Mythryl, you grant Mythryl a non-exclusive, royalty-free, worldwide licence to store, reproduce, adapt for format, publish and display that content to the extent necessary to operate and promote the Services. The licence ends when the content is deleted.
  3. You warrant that you hold the rights necessary to submit the content and that it does not infringe the rights of another person.
  4. Mythryl may remove content and is under no obligation to monitor it.
  5. A modification must not incorporate Mythryl assets beyond what is necessary for it to function, must not contain malicious software, must not be sold in a manner that requires the purchase of Mythryl assets, and must not be represented as official. Mythryl may block a modification from services it operates.
  6. Suggestions, defect reports and other feedback may be used by Mythryl without restriction, attribution or compensation.

Intellectual property

The games, including their code, artwork, audio, text and design, and the marks Mythryl, Mythryl Studio, Mythryl Online and Vestalborne, are owned by Mythryl or its licensors. No rights are granted except as set out in these terms.

Mythryl permits, without prior application, the broadcast and recording of gameplay including where you derive revenue from it, the publication of screenshots, artwork, guides and wikis, and non-commercial fan sites and projects. That permission is conditional on your not representing the material as endorsed by Mythryl, not using Mythryl marks as your own branding, not selling merchandise incorporating Mythryl assets, and not using Mythryl property in non-fungible tokens, gambling products or machine learning training data. Mythryl may withdraw the permission in respect of a particular person or project.

Claims of copyright infringement in material hosted by Mythryl should be sent to hello@mythryl.com, identifying the material and the work said to be infringed.

Suspension and termination

Where you breach these terms, Mythryl may issue a warning, remove content, reset a display name, restrict access to a feature, or suspend or terminate your account, proportionate to the breach. Mythryl will state the reason unless doing so would endanger a person, prejudice an investigation, or contravene the law. You may appeal to hello@mythryl.com.

Termination ends your access to the online Services. It does not revoke your licence to play offline a game you have lawfully acquired, unless the account was obtained by fraud.

Disclaimers and limitation of liability

The Services are provided on an "as is" and "as available" basis. Mythryl does not warrant that the Services will be uninterrupted or free of defects, and gives no warranty in respect of player-operated servers, modifications or other third-party material. You are responsible for retaining backup copies of your saved games.

Mythryl may modify, suspend or discontinue any part of the Services. Where Mythryl discontinues the account service it will give at least 30 days notice.

Nothing in these terms excludes liability that cannot be excluded at law, including liability under the Australian Consumer Law and liability for death or personal injury caused by negligence. Where the Australian Consumer Law applies and permits limitation, the liability of Mythryl for breach of a consumer guarantee is limited, at its option, to resupply of the relevant goods or services or to the cost of resupply.

Otherwise, and to the extent permitted by law, Mythryl is not liable for indirect or consequential loss, for loss of profit, revenue, data, saved games or progress, or for the acts of other players or server operators. The aggregate liability of Mythryl under these terms is limited to the greater of the amount you have paid to Mythryl in the 12 months preceding the claim and AUD 100.

General

  1. Indemnity. You indemnify Mythryl against claims, losses and reasonable costs arising from your breach of these terms, from your content, or from a server you operate, to the extent caused by you and not by Mythryl.
  2. Entire agreement. These terms and the Privacy Policy constitute the entire agreement between the parties. Statements made elsewhere, including on social platforms or in promotional material, do not form part of it.
  3. Severability. If a provision is held unenforceable it is severed and the remaining provisions continue in effect.
  4. Assignment. Mythryl may assign these terms to an acquirer of its business without affecting your rights. You may not assign yours.
  5. Waiver. A failure to enforce a provision does not waive it.
  6. Force majeure. Neither party is liable for a failure to perform caused by an event beyond its reasonable control.
  7. Survival. The licence restrictions, and the provisions concerning user content, intellectual property, disclaimers and liability, survive termination.

Governing law

These terms are governed by the law of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. Where you are a consumer resident in another jurisdiction, this does not deprive you of the protection of a mandatory law of that jurisdiction. These terms do not require arbitration and do not waive a right to participate in class proceedings.
